తెలంగాణ రాజకీయాల్లో తీవ్ర చర్చకు దారితీసిన ఖైరతాబాద్ ఎమ్మెల్యే దానం నాగేందర్ అనర్హత కేసు మరో కీలక మలుపు తిరిగింది. తెలంగాణ హైకోర్టు ఇచ్చిన అనర్హత తీర్పును సవాల్ చేస్తూ దానం నాగేందర్ దాఖలు చేసిన పిటిషన్పై సుప్రీంకోర్టు విచారణకు అనుమతించింది. ఈ పిటిషన్పై సెప్టెంబర్ 23, బుధవారం సుప్రీంకోర్టు ప్రధాన న్యాయమూర్తి ధర్మాసనం విచారణ చేపట్టనుంది.
దానం నాగేందర్ తరఫున సీనియర్ న్యాయవాది ముకుల్ రోహత్గి సుప్రీంకోర్టులో పిటిషన్ను మెన్షన్ చేశారు. తెలంగాణ హైకోర్టు తీర్పు అమలుపై స్టే ఇవ్వాలని, తన ఎమ్మెల్యే పదవిపై వచ్చిన అనర్హత నిర్ణయాన్ని సవాల్ చేస్తూ దానం నాగేందర్ సుప్రీంకోర్టును ఆశ్రయించారు.
హైకోర్టు తీర్పుపై సుప్రీంకోర్టును ఆశ్రయించిన దానం
పార్టీ ఫిరాయింపుల కేసులో దానం నాగేందర్ను తెలంగాణ హైకోర్టు సెప్టెంబర్ 18న ఎమ్మెల్యేగా అనర్హుడిగా ప్రకటించింది. అసెంబ్లీ స్పీకర్ దానం నాగేందర్పై అనర్హత పిటిషన్లను తిరస్కరిస్తూ ఇచ్చిన నిర్ణయాన్ని హైకోర్టు పక్కనపెట్టి, ఖైరతాబాద్ అసెంబ్లీ స్థానాన్ని ఖాళీగా ప్రకటించింది. ఈ తీర్పును సవాల్ చేస్తూ దానం నాగేందర్ సుప్రీంకోర్టులో అప్పీల్ దాఖలు చేశారు.
హైకోర్టు తీర్పు ప్రకారం దానం నాగేందర్ అనర్హత 2024 ఏప్రిల్ 23 నుంచి అమల్లోకి వచ్చినట్లు పేర్కొంది. అదే సమయంలో ఖైరతాబాద్ అసెంబ్లీ స్థానం ఖాళీగా ఉన్నట్లు వెల్లడించింది.
అసలు వివాదం ఏమిటి?
2023 తెలంగాణ అసెంబ్లీ ఎన్నికల్లో దానం నాగేందర్ బీఆర్ఎస్ అభ్యర్థిగా ఖైరతాబాద్ నుంచి ఎమ్మెల్యేగా విజయం సాధించారు. అనంతరం 2024లో ఆయన కాంగ్రెస్ పార్టీలో చేరారు. ఆ తర్వాత 2024 లోక్సభ ఎన్నికల్లో కాంగ్రెస్ అభ్యర్థిగా సికింద్రాబాద్ లోక్సభ నియోజకవర్గం నుంచి పోటీ చేశారు.
దీంతో ఆయనపై పార్టీ ఫిరాయింపుల నిబంధనల కింద అనర్హత వేటు వేయాలని కోరుతూ బీఆర్ఎస్ ఎమ్మెల్యే పాడి కౌశిక్ రెడ్డి, బీజేపీ ఎమ్మెల్యే ఏలేటి మహేశ్వర్ రెడ్డి వేర్వేరుగా పిటిషన్లు దాఖలు చేశారు.
దానం నాగేందర్ బీఆర్ఎస్ తరఫున ఎమ్మెల్యేగా ఎన్నికై, అనంతరం కాంగ్రెస్లో చేరి, కాంగ్రెస్ అభ్యర్థిగా లోక్సభ ఎన్నికల్లో పోటీ చేయడం ఈ కేసులో ప్రధాన అంశంగా మారింది.
స్పీకర్ నిర్ణయాన్ని పక్కనపెట్టిన హైకోర్టు
దానం నాగేందర్ అనర్హతకు సంబంధించిన పిటిషన్లపై అసెంబ్లీ స్పీకర్ నిర్ణయం తీసుకోవడంలో జాప్యం జరుగుతోందంటూ గతంలో పాడి కౌశిక్ రెడ్డి, ఏలేటి మహేశ్వర్ రెడ్డి హైకోర్టును ఆశ్రయించారు.
ఈ వ్యవహారం చివరకు సుప్రీంకోర్టు దృష్టికి కూడా వెళ్లింది. 2025 జూలై 31న సుప్రీంకోర్టు పార్టీ ఫిరాయింపులపై దాఖలైన అనర్హత పిటిషన్లను నిర్ణీత వ్యవధిలో పరిష్కరించాల్సిన అవసరంపై ఆదేశాలు జారీ చేసింది. అనంతరం స్పీకర్ దానం నాగేందర్పై దాఖలైన అనర్హత పిటిషన్లను తిరస్కరించారు. ఆ నిర్ణయాన్ని సవాల్ చేస్తూ పాడి కౌశిక్ రెడ్డి, ఏలేటి మహేశ్వర్ రెడ్డి మళ్లీ హైకోర్టును ఆశ్రయించారు.
తాజాగా తెలంగాణ హైకోర్టు స్పీకర్ నిర్ణయాన్ని పక్కనపెట్టి దానం నాగేందర్ను అనర్హుడిగా ప్రకటించింది. తీర్పు ప్రతులను అసెంబ్లీ స్పీకర్, అసెంబ్లీ కార్యదర్శి, ఎన్నికల సంఘానికి పంపాలని రిజిస్ట్రీని ఆదేశించింది.
ఇప్పుడు సుప్రీంకోర్టులో ఏం జరగనుంది?
హైకోర్టు తీర్పుపై దానం నాగేందర్ సుప్రీంకోర్టులో దాఖలు చేసిన పిటిషన్ సెప్టెంబర్ 23న విచారణకు రానుంది. ముఖ్యంగా తెలంగాణ హైకోర్టు ఇచ్చిన అనర్హత తీర్పుపై స్టే ఇవ్వాలన్న దానం నాగేందర్ అభ్యర్థనను సుప్రీంకోర్టు పరిశీలించే అవకాశం ఉంది.
అయితే సుప్రీంకోర్టు విచారణకు అనుమతించడం మాత్రమే హైకోర్టు తీర్పుపై స్టే ఇచ్చినట్లుగా భావించరాదు. స్టే లేదా ఇతర మధ్యంతర ఉత్తర్వులపై సుప్రీంకోర్టు విచారణ సమయంలోనే నిర్ణయం వెలువడే అవకాశం ఉంటుంది.

Danam Nagender Disqualification Case Supreme Court to Hear Plea on September 23
New Delhi/Hyderabad, September 21, 2026: The Danam Nagender disqualification case has reached another crucial stage, with the Supreme Court agreeing to hear the plea filed by former Khairatabad MLA Danam Nagender challenging the Telangana High Court’s order disqualifying him from the Telangana Legislative Assembly.
Nagender has approached the Supreme Court seeking relief against the Telangana High Court disqualification order. His petition is scheduled to come up before the Chief Justice of India-led bench on Wednesday, September 23. Senior advocate Mukul Rohatgi, appearing for Danam Nagender, mentioned the matter before the Supreme Court seeking urgent consideration.
The development comes days after the Telangana High Court disqualified Danam Nagender as Khairatabad MLA in a case concerning alleged defection from the Bharat Rashtra Samithi (BRS) to the Congress.
Danam Nagender challenges Telangana High Court verdict
The Danam Nagender disqualification case stems from his political transition after the 2023 Telangana Assembly elections.
Nagender was elected from the Khairatabad Assembly constituency on a BRS ticket in the 2023 Telangana Assembly elections. He subsequently joined the Congress and contested the 2024 Lok Sabha elections from Secunderabad as a Congress candidate while still being an MLA.
The Telangana High Court held that this attracted the disqualification provisions under the Tenth Schedule of the Constitution, commonly known as the anti-defection law. The court declared Nagender disqualified from April 23, 2024, and consequently held the Khairatabad Assembly seat vacant.
Danam Nagender has now challenged that decision before the Supreme Court of India, seeking a stay on the Telangana High Court verdict.
What is the Danam Nagender disqualification case?
The dispute began with petitions seeking Danam Nagender’s disqualification as an MLA.
BRS MLA Padi Kaushik Reddy and BJP MLA Alleti Maheshwar Reddy approached the Telangana Assembly Speaker seeking action against Nagender under the anti-defection provisions.
The petitioners argued that Nagender had won the Khairatabad Assembly seat as a BRS candidate but subsequently joined Congress and contested the Lok Sabha election from Secunderabad on a Congress ticket.
The Supreme Court had earlier dealt with petitions concerning delays in deciding disqualification proceedings involving BRS MLAs who joined Congress. Its July 31, 2025 judgment records that Alleti Maheshwar Reddy had separately filed a petition seeking Danam Nagender’s disqualification.
Telangana Speaker’s decision overturned by High Court
Following directions from the Supreme Court, the Telangana Assembly Speaker, acting as the Chairman of the tribunal under the Tenth Schedule, conducted an inquiry into the disqualification complaints.
The Speaker subsequently rejected the disqualification petitions against Danam Nagender.
Padi Kaushik Reddy and Alleti Maheshwar Reddy challenged the Speaker’s decision before the Telangana High Court.
On September 18, 2026, a Division Bench comprising Chief Justice Aparesh Kumar Singh and Justice G.M. Mohiuddin set aside the Speaker’s decision and disqualified Danam Nagender as an MLA. The Registry was also directed to communicate the judgment to the Assembly Speaker and the Election Commission.
Why September 23 is important
The upcoming September 23 Supreme Court hearing in the Danam Nagender disqualification case is significant because Nagender is seeking relief against the High Court judgment.
His legal team is seeking a stay on the Telangana High Court order. However, the fact that the Supreme Court has agreed to hear the petition does not itself mean that a stay has been granted. Any interim relief will depend on the orders passed by the Supreme Court during the hearing.
The Supreme Court proceedings could therefore determine the immediate legal status of the Khairatabad Assembly seat and the next course of action in the Danam Nagender disqualification case.
BRS and BJP file caveats
The legal battle has also expanded to the Supreme Court. Reports indicate that both the BRS and BJP have filed caveat petitions, seeking an opportunity to be heard before any order is passed on Nagender’s challenge to the High Court verdict.
A caveat allows a party to request that the court hear its submissions before passing an order that could affect that party’s interests.

The Telangana High Court’s ruling has placed the Khairatabad Assembly constituency at the centre of a major legal and political dispute.
The High Court specifically held that Nagender stood disqualified from April 23, 2024, and that the Khairatabad seat was rendered vacant. The court also declined a request to keep its order in abeyance to allow Nagender to approach the Supreme Court.
With the matter now before the Supreme Court, the Danam Nagender disqualification case is entering its next legal phase.
